Welcome to Houswin.

These Terms & Conditions (“Terms”) govern your access to and use of the Houswin website, including houswin.us (the “Website”), and purchases made directly from Houswin.

Please read these Terms carefully before using the Website or purchasing a Houswin product. By accessing the Website, placing an order, or otherwise using our services, you agree to these Terms.

If you do not agree to these Terms, please do not use the Website or place an order.

1. Definitions

For purposes of these Terms:

“Houswin,” “Company,” “we,” “us,” and “our” refer to Houswin.

“Website” means houswin.us and the webpages, features, content, and services made available through it.

“Product” or “Products” means products, accessories, replacement parts, and other goods offered for sale by Houswin.

“Order” means a request to purchase Products from Houswin.

“Customer,” “you,” and “your” mean the individual or legal entity accessing the Website, placing an Order, purchasing a Product, or otherwise using our services, as applicable.

“Policies” means the additional policies published by Houswin that may apply to your use of the Website or purchase and use of Products, including our Privacy Policy, Refunds & Returns Policy, warranty terms, shipping information, and applicable product documentation.

2. Acceptance of These Terms

By accessing or using the Website or purchasing Products directly from Houswin, you agree to be bound by these Terms and any applicable Houswin Policies.

If you are using the Website or placing an Order on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.

You must be legally capable of entering into a binding agreement to place an Order through the Website.

3. Products and Product Information

Houswin makes reasonable efforts to provide accurate descriptions, specifications, photographs, pricing, availability, compatibility information, and other Product information.

However, product information may occasionally contain errors, omissions, or outdated information. Product appearance may also vary slightly from photographs because of manufacturing changes, display settings, lighting, or other factors.

We reserve the right to correct errors or omissions and update Product information when necessary.

Houswin may modify Products, components, packaging, specifications, accessories, or documentation as products are developed and improved, subject to applicable law.

Customers are responsible for reviewing the applicable Product information and documentation before purchase, installation, or use.

4. Orders

Submitting an Order does not necessarily mean that Houswin has accepted it.

We reserve the right, subject to applicable law, to accept, decline, limit, or cancel an Order when reasonably necessary, including because of:

  • Product availability;

  • Pricing or listing errors;

  • Payment or billing problems;

  • Suspected fraud or unauthorized activity;

  • Shipping restrictions;

  • Incorrect customer or delivery information; or

  • Circumstances that prevent us from reasonably fulfilling the Order.

If we cancel an Order after payment has been collected and before the Product is shipped, we will refund the applicable amount to the original payment method.

5. Pricing and Payment

Prices displayed on the Website are shown in U.S. dollars unless otherwise stated.

Applicable taxes, shipping charges, and other charges may be calculated and displayed during checkout.

You agree to provide current, complete, and accurate billing and payment information when placing an Order.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your Order.

We reserve the right to correct pricing errors. If a material pricing error affects an Order you have already submitted, we may contact you for instructions or cancel and refund the affected Order, as permitted by law.

6. Shipping and Delivery

Orders are processed and shipped according to the shipping information and policies published by Houswin.

Shipping and delivery dates are estimates unless Houswin expressly states otherwise in writing.

Delivery may be affected by product availability, payment verification, carrier delays, weather, incorrect delivery information, or circumstances outside Houswin’s reasonable control.

Customers are responsible for providing an accurate and complete shipping address.

Any applicable shipping charges will be disclosed during checkout or otherwise before the Order is completed.

7. Cancellations, Returns, Exchanges, and Refunds

Purchases made directly from Houswin are subject to the current Houswin Refunds & Returns Policy.

That policy explains applicable requirements concerning:

  • Order cancellations;

  • Return eligibility;

  • Return windows;

  • Product condition requirements;

  • Return Merchandise Authorization (RMA) numbers;

  • Restocking fees;

  • Exchanges;

  • Return shipping;

  • Damaged, defective, missing, or incorrect items; and

  • Refund processing.

The Refunds & Returns Policy is incorporated into these Terms by reference.

If there is a conflict between this section and the current Refunds & Returns Policy regarding a return, exchange, cancellation, or refund, the Refunds & Returns Policy will control for that matter, subject to applicable law.

8. Product Warranty

Certain Houswin Products may be covered by an express written warranty.

The warranty applicable to a Product, if any, is governed by the warranty terms provided with that Product or published by Houswin.

Nothing in these Terms is intended to replace, expand, or reduce an express written Houswin warranty except where expressly stated in that warranty and permitted by law.

Unauthorized modifications, improper installation, misuse, improper maintenance, operation contrary to product instructions, or use outside the Product’s intended conditions may affect warranty coverage as described in the applicable warranty terms.

Any rights you have under applicable consumer protection law remain subject to those laws.

9. Product Safety and Proper Use

Houswin Products must be installed, operated, maintained, transported, and stored according to the instructions, warnings, specifications, and safety information provided with the applicable Product.

Before installing or using a Product, you are responsible for reading and understanding the applicable Product documentation.

Certain Houswin Products involve fuel combustion, heated components, electrical systems, exhaust gases, and other conditions that can create serious hazards if a Product is installed or operated incorrectly.

Improper installation, ventilation, fuel handling, modification, maintenance, or operation may result in fire, burns, carbon monoxide exposure, equipment damage, serious injury, or death.

Always follow the applicable safety instructions.

Never use a Houswin Product in a manner prohibited by its documentation or safety warnings.

Product exhaust must be installed and routed as required by the applicable Product documentation. Exhaust gases must not be discharged into occupied or enclosed spaces.

Do not modify combustion, fuel, electrical, exhaust, or safety-related components unless the modification is expressly authorized by Houswin.

The Website and these Terms are not substitutes for the applicable Owner Manual, installation instructions, safety warnings, or other Product-specific documentation.

10. Intended Use and Customer Responsibility

You are responsible for determining whether a Product is appropriate for your intended application before installation or use.

You are also responsible for following applicable laws, regulations, codes, and requirements relating to the installation and use of the Product.

Do not rely solely on marketing materials, photographs, social media content, customer reviews, or general Website content when making safety, installation, compatibility, or operating decisions.

Refer to the applicable Houswin Product documentation and contact Houswin support if you have questions before installation or operation.

11. Website Use

You may use the Website only for lawful purposes.

You may not:

  • Use the Website in violation of applicable law;

  • Attempt to gain unauthorized access to the Website, servers, accounts, or systems;

  • Introduce viruses, malware, malicious code, or other harmful technology;

  • Interfere with the operation or security of the Website;

  • Graphics;

  • Product documentation;

  • Manuals;

  • Technical illustrations; and

  • Other original Houswin materials.

You may access and use Website content for your personal, lawful use.

You may not reproduce, distribute, modify, sell, republish, commercially exploit, or create derivative works from Houswin content without authorization from Houswin, except as permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSWIN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE OR PRODUCTS, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSWIN’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO HOUSWIN FOR THE PRODUCT GIVING RISE TO THE CLAIM.

THESE LIMITATIONS ARE NOT INTENDED TO LIMIT LIABILITY THAT CANNOT LEGALLY BE LIMITED, INCLUDING ANY LIABILITY THAT APPLICABLE LAW EXPRESSLY PROHIBITS A BUSINESS FROM DISCLAIMING OR LIMITING.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the greatest extent permitted by law.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Houswin and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Website, violation of these Terms, infringement of another person’s rights, or intentional misuse or unauthorized modification of a Houswin Product.

This section does not require you to indemnify Houswin for conduct for which indemnification cannot lawfully be required.

Access to the Website from a particular location does not mean that Houswin offers or ships every Product to that location.

You are responsible for complying with applicable local laws when accessing the Website or purchasing, importing, installing, or using Products.

You represent that you are not prohibited from conducting the applicable transaction under United States trade restrictions, sanctions, or other applicable laws.

Customers outside the United States may have mandatory consumer rights that cannot be waived by these Terms.

Nothing in this section deprives a consumer of rights or protections that cannot lawfully be waived under applicable law.

Both you and Houswin are encouraged to make a reasonable good-faith effort to resolve the matter informally before pursuing formal legal remedies.

Nothing in this section prevents either party from exercising rights or remedies that cannot lawfully be restricted.

21. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified to the minimum extent necessary to make it enforceable.

The remaining provisions will remain in effect.

22. Waiver

If Houswin does not enforce a provision of these Terms on one occasion, that does not mean Houswin has permanently waived that provision or its right to enforce it later.

A waiver of one breach does not constitute a waiver of another or subsequent breach.

23. Entire Agreement and Related Policies

These Terms, together with the Policies expressly incorporated by reference and any additional terms presented in connection with a specific transaction, constitute the applicable agreement between you and Houswin regarding your use of the Website and purchases made directly from Houswin.

Product-specific documentation, warranty terms, safety instructions, and other applicable written terms remain effective according to their stated purpose.

24. Changes to These Terms

Houswin may update these Terms from time to time to reflect changes to our Website, Products, business practices, Policies, or legal requirements.

When we make changes, we will update the Effective Date displayed at the top of this page.

Changes will apply prospectively unless applicable law requires otherwise.
